Terms of service

These terms are between Philip Hynes, trading as Kishtin ("we") and the company that signs up to Kishtin ("you"). By signing up you agree to them on your company's behalf.

1. What Kishtin is

Kishtin is software for designing kitchens and making them: the designer, the library of units, renders, quotes, the job pack and the cut lists. We provide it over the internet: you use it through a web browser at your company's own address on kishtin.ie.

2. Your company and your team

The person who signs up is your company's first administrator and can invite your team. You are responsible for who you give access to and for what they do in Kishtin. Keep passwords to yourselves, and tell us at info@kishtin.ie if you think an account has been misused.

3. The free days and paying

A new company has 14 days free. After them the plan you chose is billed monthly or yearly, in advance, through our payment provider, Stripe. Prices are as shown on our plans page when you are billed, before VAT, which is added where it applies.

You can change plan or stop at any time from your admin screen. Stopping takes effect at the end of the period already paid for, and we do not refund part of a period.

If a payment fails we will tell you by email. If it is still unpaid after 14 days, your company becomes read only until it is paid.

4. Your work is yours

Your designs, your library, your customers' details and everything else your team puts into Kishtin stay yours. We use them only to provide Kishtin to you, and for support when you ask for it. Our privacy notice says how personal data in them is handled; for that data we act on your instructions, as your processor.

The starter library of units is provided for you to use and change within Kishtin.

5. Fair use

Use Kishtin for your own business. Do not try to get at another company's work, overload the service, copy or resell the software, or use it for anything unlawful. Each plan's limits, such as people and renders a month, are on the plans page.

6. Keeping Kishtin running

We aim to keep Kishtin available at all times and back up every company's work every night. Some work needs a short pause, which we do outside working hours where we can. We do not promise Kishtin will never be unavailable.

Kishtin produces drawings, cut lists and files for machines from what your team enters. Check them before cutting: you are responsible for what is made from them.

7. Responsibility

Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability to you in any year is limited to what you paid us in that year, and we are not liable for lost profits, lost business or indirect loss.

8. Ending

When your company stops, we keep its work for 30 days so you can ask for a copy, then delete it. We may end these terms if you break them seriously and do not put it right within 14 days of our telling you.

9. Changes

We may change these terms. We will email your administrators at least 30 days before a change that affects you, and you may stop before it takes effect.

10. Law

These terms are under the law of Northern Ireland, and its courts decide any dispute.
